Fished the first island this afternoon with David Jones in the 20kt. wind and put a smack down on the stripers. 18 fish in about 3 hrs. Only one other boat anchored up. Had to leave for family time or could have kept going. To bad bay seaspn is closed. Ed

Ever been harassed by VMRC doing the closed season even though your are only C and R? I have been questioned/checked a couple of times throughout the years but never had any problems. Question I hear is what is the difference between C and R in the Bay vs. C and R out past 3 miles? One seems frowned upon more than the other.

Short answer is you are not allowed to even "fish" for stripers in the ocean outside 3 miles EEZ.

In the Chesapeake Bay, catch-and-release striper fishing is legal and you can even get a release citation from the salt water fishing tournament for catching and releasing a striper over 44-inches in the "closed" season. The reason you get checked in the bay after the season is closed is they want to make sure you have not kept any fish from inside the Bay. So the Bay is catch-and-release no possession IF FISHING. Ocean you can keep fish over 28-inches a day. Remember, if you go into the ocean and catch and keep a legal fish you CANNOT fish inside the Bay after that. If you have a fish in the box WHILE FISHING inside the Bay you will likely get a ticket. You CAN possess the ocean caught legal fish in the Bay if you are traveling on home....say to a ramp in Norfolk. just do not stop go directly from the ocean to your home port. Does that make sense?

The Bay vs ocean line is here....(go by this since it is on their web site, bit I think it might be wrong). The dashed line to the right, from the Smith Island Light is the historical Bay line. To be safe consider inside either no possession C and R outside to 3 miles 2 a day over 28-inches.
